TERMS OF SERVICE & PRIVACY POLICY

1. Corporate Identity and Jurisdiction

TicAll Media is a business entity legally incorporated and registered in the State of New Jersey.

Commercial Presence: Our primary commercial office for client relations and executive meetings is located at 276 5th Avenue, Suite 704, New York, NY 10001.
Governing Law: All services, contracts, and legal disputes shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions.

2. Proprietary Infrastructure (Ticall Flow™)

TicAll Media provides advanced automated communication and AI-driven solutions through its proprietary framework, Ticall Flow™.

Ownership of Intellectual Property: All software code, logic, conversational workflows, API integrations, and technical architectures developed by TicAll Media remain the exclusive intellectual property of TicAll Media.
License of Use: Clients are granted a limited, non-exclusive, and non-transferable license to use the Ticall Flow™ infrastructure during the duration of their active service agreement. This license does not constitute a sale of the software or the underlying code.
Protection: Any unauthorized reproduction, reverse engineering, or distribution of the Ticall Flow™ framework is strictly prohibited.

3. Data Processing & Bot Development

Regarding the development and deployment of automated solutions:

Data Roles: TicAll Media acts as a Data Processor. The Client (the business owner) acts as the Data Controller.
End-User Privacy: The Client is solely responsible for ensuring that their automated communications comply with the Telephone Consumer Protection Act (TCPA) and other relevant privacy regulations.
Information Security: Ticall Flow™ processes data to execute automated responses and improve system performance. We do not sell, rent, or lease end-user databases to third parties.

4. Service Continuity & Third-Party Platforms

TicAll Media utilizes world-class ecosystems, including the Meta/WhatsApp Business API, to power our solutions. While we ensure our infrastructure is always aligned with the highest industry standards, TicAll Media is not liable for service changes, policy updates, or temporary interruptions originating from these third-party providers.

5. System Optimization

To guarantee the peak performance of the Ticall Flow™ framework, we periodically perform system optimizations and updates. These enhancements are designed to improve security, speed, and overall reliability, ensuring our clients always have access to the most advanced version of our technology.

6. Professional Conduct

Our New York City location is a corporate administrative space. To ensure the highest level of service and privacy, all in-person consultations with TicAll Media representatives are held strictly by appointment only.
